These General Terms and Conditions ("hob-hob GTC"), together with the Privacy Policy, govern the use of the hob-hob online platform ("hob-hob Platform"), accessible through www.hob-hob.com and hob-hob’s mobile applications ("hob-hob Apps").
The hob-hob platform is available to users worldwide, connecting explorers (users booking experiences) with creators (users offering experiences) for photography and videography-related activities. By using our platform, you agree to comply with these GTC.
1. About us
1.1 Hob-hob is an online marketplace that connects explorers with independent creators offering photography-related experiences, such as, but not limited to, workshops, photowalks, photoshoots or creative photo/video sessions. The platform enables users to discover, book and securely pay for these experiences.
1.2 Hob-hob serves as an intermediary between explorers and creators, enabling them to connect and arrange photography-related experiences. Hob-hob does not assume responsibility for the execution, quality or fulfillment of any experience booked through the platform.
1.3 Payments on hob-hob are processed securely through Stripe using Stripe Connect (Standard). hob-hob does not hold user funds. Payments are transferred directly to the creator, with applicable fees deducted during the transaction process.
2. Scope
2.1 Hob-hob GTC apply to all visitors and users of the hob-hob platform, including explorers and creators.
2.2 The use of the hob-hob platform is strictly personal. The resale of experience bookings or using the platform for unauthorized commercial purposes is prohibited unless expressly permitted by hob-hob in writing.
3. Role of hob-hob and user responsibilities
3.1 Hob-hob provides a marketplace where explorers and creators can connect to offer and book photography-related experiences. While hob-hob facilitates these interactions, it does not provide, organize, or oversee the experiences themselves. Users are responsible for ensuring that experiences meet their expectations.
3.2 Creators are responsible for the accuracy and quality of their listings, including any descriptions, images, pricing, and experience details. All images uploaded must be their own, or they must have the legal rights and permissions to use them. If an image includes identifiable individuals, creators must have their explicit consent before sharing the image.
3.3 When booking an experience, users enter into a direct agreement with each other. Any changes, cancellations, disputes, or concerns regarding an experience must be resolved between the explorer and the creator. Hob-hob provides the platform for these transactions but does not mediate disputes unless legally required.
3.4 hob-hob does not provide insurance coverage. All users are responsible for their own safety and protection during experiences. Explorers must ensure they have appropriate personal insurance and acknowledge that participation is at their own risk. Creators are required to have suitable liability or business insurance for the experiences they offer but are not liable for injuries, accidents, or damages affecting explorers, unless caused by gross negligence. hob-hob is not liable for any incidents or losses occurring during experiences.
3.5 Hob-hob reserves the right to limit, restrict, or deny access to the platform in cases of suspected fraud, misuse, or violations of these Terms and Conditions. This includes inappropriate behaviour, misleading listings, and failure to comply with platform policies.
3.6 All users are expected to treat each other with respect and communicate in a professional, inclusive, and non-discriminatory manner. Any form of harassment, abuse, racism, sexism, hate speech, or disruptive behavior is strictly prohibited and may result in suspension or account termination.
3.7 Users must not share violent, sexual, or otherwise inappropriate content through listings, messages, or any platform feature. Hob-hob reserves the right to remove any content that violates these standards or encourages illegal activities.
4. Accounts, listings, and creator requirements
4.1 Users must register for a free account to book experiences as explorers, list experiences as creators, or access additional platform features such as messaging, saving experiences, or managing bookings. Browsing the hob-hob platform is possible without registration.
4.2 Users are responsible for keeping their account credentials secure. Hob-hob will not be liable for unauthorized access or misuse of an account.
4.3 Hob-hob reserves the right to suspend or terminate accounts that engage in fraudulent activities, violate these GTC, or misuse the platform in any manner.
4.4 Hob-hob reserves the right to decline, remove, or modify any listing that does not meet these criteria.
4.5 Creators on hob-hob may be professionals, hobbyists, amateurs, or individuals with a creative passion for photography. All experience listings must align with hob-hob’s focus on photography or videography.
4.6 Before being published, each listing is reviewed by hob-hob to ensure it meets quality and safety standards. Listings must include complete and accurate details (title, description, pricing, and images), a connected and verified Stripe Standard account for payments, and must not include harmful, misleading, unlawful, discriminatory, or inappropriate content.
4.7 Creators are solely responsible for the accuracy and legality of their listings. They must hold all necessary rights to images and materials they upload and comply with applicable tax, legal, and permit requirements.
4.8 For privacy reasons, only an approximate experience location is displayed before booking. The exact meeting point is disclosed only after confirmation of the booking.
4.9 To receive payments, creators must create or connect a Stripe Standard account. Stripe manages the onboarding and verification process, which may take up to 7–10 days for the first payout. hob-hob does not access or control Stripe's system and is not responsible for any delays, fees, or technical issues. Alternative payment methods are not supported.
5. Payment and Refunds
5.1 All payments on hob-hob are processed through Stripe, a certified third-party payment provider using Stripe Connect (Standard). When an explorer books an experience, the full amount is paid directly into the creator’s Stripe account. hob-hob does not collect or hold user funds at any time.
5.2 hob-hob applies a platform commission fee to each completed transaction. This fee is automatically deducted at the time of payment, together with Stripe’s transaction processing fee. The remaining amount is then transferred directly to the creator’s Stripe account. hob-hob does not control Stripe’s fee structure and is not responsible for any deductions, delays, or issues related to Stripe’s payout process.
5.3 hob-hob does not offer offline payment options. All transactions must be completed through the integrated Stripe system for user protection and platform security.
5.4 If an explorer cancels an experience at least 24 hours before the scheduled time, they are entitled to a full refund. If the cancellation occurs less than 24 hours before the scheduled time, the booking is considered non-refundable. If a creator cancels an experience at any time, the explorer will receive a full refund. Refunds are issued to the original payment method used at the time of booking. hob-hob does not offer alternative refund options such as platform credits or transfers.
5.5 Hob-hob is not responsible for any payment disputes between users. In case of a dispute, explorers and creators must resolve the issue directly or via Stripe. hob-hob may assist with supporting documentation but does not intervene in dispute decisions.
5.6 Disputes initiated by explorers through their bank or card issuer (e.g., chargebacks) are handled directly by Stripe and may lead to a temporary or permanent reversal of funds. hob-hob does not control this process and is not liable for any resulting fees or deductions. Creators are solely responsible for maintaining documentation and complying with Stripe’s dispute resolution procedures.
5.7 For more information about Stripe’s services and dispute handling, users are encouraged to consult: https://stripe.com/docs. Hob-hob is not affiliated with Stripe beyond the integration of its payment services and assumes no liability for Stripe’s decisions or actions relating to user accounts or payments.
6. Cancellations & Rescheduling
6.1 Hob-hob allows explorers to cancel an experience more than 24 hours before the scheduled time and receive a full refund. If the cancellation occurs less than 24 hours before the scheduled time, the booking is considered non-refundable. In all cases, Stripe transaction fees are non-refundable and will be deducted from the refunded amount where applicable.
6.2 If a creator cancels an experience at any time, the explorer will receive a full refund of the booking amount. Please note that Stripe’s transaction fees are non-refundable and will be deducted from the refunded amount where applicable. hob-hob reserves the right to suspend or remove creators who repeatedly cancel experiences, as frequent cancellations undermine trust and reliability on the platform.
6.3 Rescheduling is only possible if both the explorer and creator mutually agree. Hob-hob is not responsible for coordinating or enforcing rescheduling arrangements and does not guarantee the availability of alternative dates. Any changes to the original booking, including rescheduling, must be agreed upon directly between the users. It is recommended to confirm such changes in writing for clarity and record-keeping.
6.4 A creator may cancel an experience at short notice if external circumstances make it impossible or significantly unsafe to proceed. Such circumstances include, but are not limited to, extreme weather conditions, government restrictions or official orders, strikes or transportation disruptions, and unforeseeable technical or personal emergencies that prevent the creator from delivering the experience.
6.5 If a creator cancels due to any of the above reasons, the full booking price will be refunded to the explorer. Please note that Stripe’s transaction fees are non-refundable and will not be reimbursed. Any additional compensation requests must be directed to the creator directly.
6.6 A creator may refuse an explorer’s participation in an experience if the explorer does not meet the clearly stated requirements outlined in the listing (e.g., age limits, physical ability, required equipment). Creators may also deny participation if the explorer’s behavior poses a safety risk, disrupts the experience, or violates reasonable conduct expectations. In such cases, no refund will be issued. Creators are expected to exercise this right fairly, without discrimination, and in accordance with applicable laws.
6.7 A creator may implement minor changes to the experience program when necessary due to short-term circumstances. Such changes must not significantly alter the core nature of the experience and should be communicated to the explorer as early as possible.
7. Reviews & User Content
7.1 Hob-hob allows users to read and submit reviews and other content regarding experiences, which reflect personal opinions and do not represent hob-hob’s views. Reviews reflect the personal opinions of individual users at a specific point in time. The perception of an experience may change over time, and experiences may be updated or modified by creators after a review is posted.
7.2 Reviews and ratings should be considered as part of a broader perspective, and a single review does not necessarily reflect the overall quality of an experience. The total number of reviews and the average rating should be taken into account when assessing an experience.
7.3 Users can contribute to the hob-hob platform by writing reviews and posting photos of experiences they have attended. Users are fully responsible for the content they post. It is strictly prohibited to upload or post:
• Content that is false, misleading, or deceptive.
• Reviews written in exchange for compensation or incentives.
• Advertisements for external services, products, or companies.
• Reviews that violate the privacy, intellectual property, or legal rights of others.
• Content that contains offensive language, discrimination, hate speech, violence, or illegal activity.
7.4 Users must ensure that they have the necessary rights before uploading content. In particular:
• Photos containing identifiable individuals should only be uploaded with their explicit consent.
• Users may not upload copyrighted material unless they are the rightful owner.
7.5 Hob-hob reserves the right to remove or edit reviews and content that violate these guidelines.
8. Data Protection
8.1 Hob-hob processes all user data in accordance with its Privacy Policy and in compliance with applicable data protection laws, including the Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR), where applicable.
8.2 Hob-hob collects and processes personal data for the purpose of operating and maintaining the platform, facilitating bookings and payments, improving user experience, providing customer support, and conducting marketing and promotional activities.
8.3 Hob-hob may share limited user data with trusted third-party service providers, such as payment processors (e.g., Stripe), analytics tools (e.g., Google Analytics), and advertising and marketing platforms (e.g., Meta, Google Ads, email tools). These providers support platform functionality, help analyze performance, and assist in targeted communication. By using the platform, users consent to such data processing.
8.4 Users have the right to request access to their data, modify account settings, or delete their personal information by contacting hob-hob support.
8.5 The hob-hob platform provides automatic translations to make content accessible in multiple languages. These translations are generated by software and may contain errors or inaccuracies. Users should verify critical details (e.g., meeting locations, special requirements) in the original language of the listing to ensure accuracy. Hob-hob is not responsible for any misunderstandings or misinterpretations caused by automated translations.
9. Pricing & Taxes
9.1 The prices of experiences are set by the creators and are displayed on the hob-hob platform.
9.2 The prices may be subject to additional fees, special provisions, or conditions.
9.3 By completing a booking, users authorize hob-hob to process the payment through Stripe on behalf of the creator.
9.4 By authorizing payment, users consent to their payment information being used to process the transaction for the creator. Hob-hob reserves the right to limit access to certain payment methods based on a user's creditworthiness or payment history.
9.5 Users are responsible for complying with any applicable tax regulations in their jurisdiction. Hob-hob does not collect or remit taxes on behalf of users, and creators must ensure they comply with VAT or other local tax obligations.
10. Liability & Legal Protection
10.1 Hob-hob does not guarantee uninterrupted access to the platform and is not liable for outages or technical failures. Users acknowledge that the platform may be subject to maintenance, technical disruptions, or third-party service issues that could temporarily affect availability.
10.2 Hob-hob is not liable for:
• Injuries, property damage, or losses occurring during an experience.
• Accidents, theft, or other unforeseen incidents.
• Any failure by creators or explorers to fulfill their contractual obligations.
• Loss or damage arising from force majeure events, including natural disasters, cyberattacks, or government restrictions.
10.3 Hob-hob does not employ creators. They are independent users responsible for their own legal and tax compliance. Creators are solely responsible for ensuring that their experiences comply with local laws, safety regulations, and any necessary permits or insurance requirements.
11. Indemnification
11.1 Users agree to fully indemnify and hold harmless Hob-hob, its affiliates, employees, and partners from any claims, liabilities, damages, or legal costs arising from:
• Any misrepresentation, act, or omission by the user in connection with their use of the hob-hob platform.
• Any breach of these Terms and Conditions or violation of applicable laws.
• Any claims made by third parties due to the user’s content, conduct, or activities on the platform.
11.2 Users are solely responsible for their interactions, agreements, and transactions with other users on the platform. Hob-hob is not liable for any disputes, financial losses, or damages resulting from such interactions. Users acknowledge that they enter into agreements at their own risk and should exercise due diligence when booking or providing experiences.
12. Governing Law & Final Provisions
12.1 These GTC are governed by Swiss law. Users agree that all rights, obligations, and transactions arising from the use of the hob-hob platform shall be interpreted in accordance with Swiss law.
12.2 Disputes will be handled in the courts of Zurich, Switzerland. If a legal dispute arises, users agree to submit to the exclusive jurisdiction of the Zurich courts.
12.3 Hob-hob reserves the right to update these terms and will notify users of significant changes. Continued use of the platform after updates take effect constitutes acceptance of the revised Terms and Conditions.
12.4 hob-hob may add, modify, or remove features of the platform at any time to improve functionality or user experience. While significant changes will be communicated, hob-hob is not obligated to notify users of every platform update. Users are responsible for reviewing these terms periodically. Continued use of the platform following updates constitutes acceptance of the revised terms.
